Spain's top prosecutor, the country's chief legal officer, has been compelled to step down after being convicted of revealing confidential information in a highly contentious case that has accentuated political rifts within the country.

Court Ruling and Penalties

The highest court found that García Ortiz had unlawfully revealed information about the tax status of businessman a prominent business figure, who is the partner of a leading opposition figure.

The court handed down a two-year ban from his position and a fine of €7,200. Furthermore, he must pay ten thousand euros to Mr González Amador as restitution.

Political Consequences

The legal proceedings of García Ortiz fueled the already acrimonious relations between the left-wing government of Prime Minister Pedro Sánchez and the right-wing opposition.

Divergent viewpoints were underlined by reactions to the conviction.

"The prime minister must offer an apology to Spaniards, step down and schedule new elections, in that order," said Ester Muñoz for the conservative People's Party.

The administration stated it disagreed with the decision but acknowledged it and would move forward with the appointment of a new attorney general.

Nevertheless, numerous progressive lawmakers expressed outrage at what they viewed as a politically motivated ruling.

The complicated legal matter originated in spring of 2024, when the attorney general's office issued a press release indicating that the businessman had requested a plea bargain after being discovered avoiding tax obligations worth €350,951.

The statement corrected mistaken press reports stating that the attorney general's office had initiated the settlement.

The source of the incorrect reports was the head of communications of the conservative regional president of the capital region.

Legal Proceedings

The businessman filed a complaint against the chief prosecutor, claiming his privacy had been breached. The case against the attorney general also saw him accused of leaking information about the matter to the media.

Legal authorities highlighted the attorney general's decision to replace his mobile device as incriminating.

Yet, there was no direct evidence linking García Ortiz to the leak and several journalists testified during the proceedings that he had not been the source of their information.

Concerning the official communication, the attorney general stated he was merely rectifying the erroneous reports.

The attorney general can appeal against the ruling.
